These Terms and Conditions (“Terms”) govern your access to and use of the website and learning services provided by Omega Collega SA (“we”, “us” or “our”). By registering, enrolling or otherwise using our Site or services, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.

1. Definitions

  • Site: https://www.omegacollegasa.co.za and any associated subdomains.

  • User: Any person who accesses the Site or enrols in courses.

  • Course: Any programme, class, workshop, exam or learning material offered by Omega Collega SA.

  • Course Fees: All amounts payable for registration, tuition, materials, examinations and other related services.

2. Eligibility

You must be at least 18 years old or have legal capacity to enter into a contract in South Africa. By using our Site or enrolling in a Course, you represent and warrant that you meet these requirements.

3. Account Registration

  • To enroll in a Course, you must create an account and provide accurate, current information.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

  • You must notify us immediately of any unauthorized use or security breach.

4. Course Enrolment & Payment

  1. Enrolment: Subject to availability and approval of your registration.

  2. Payment: All Course Fees must be paid in full by the due date specified in your invoice or enrolment confirmation. We accept payment via the methods detailed on our Site.

  3. Late Payment: Failure to pay on time may result in suspension or cancellation of your enrolment without refund.

  4. Refunds & Withdrawals: Governed by our Refund Policy.

5. Intellectual Property

  • All content on the Site (text, graphics, logos, videos, course materials, software) is owned or licensed by Omega Collega SA and is protected by South African and international copyright, trademark and other intellectual property laws.

  • You may download and print materials only for your personal, non-commercial use in connection with your enrolment.

  • Any other use—including reproduction, distribution, modification or public display—is strictly prohibited without our prior written consent.

6. User Conduct

You agree not to:

  • Use the Site or Services for any unlawful purpose or in violation of any applicable law.

  • Copy, distribute or post any content from the Site except as expressly permitted.

  • Harass, threaten, defame or infringe the rights of others.

  • Interfere with or disrupt the integrity or performance of the Site.

  • Attempt to gain unauthorised access to areas of the Site or other users’ accounts.

7. Termination

  • We may suspend or terminate your access to the Site or Services at any time, with or without cause and with or without notice.

  • On termination, your right to use the Site and Services immediately ceases, but your obligations (e.g., payment obligations, confidentiality, intellectual property restrictions) survive.

8. Disclaimers & Warranties

  • No Warranty: The Site and Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding accuracy, reliability, fitness for a particular purpose or uninterrupted availability.

  • Educational Results: We do not guarantee any specific learning outcomes or job placement.

9. Limitation of Liability

To the maximum extent permitted by law, Omega Collega SA and its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to these Terms, your use of the Site or enrolment in a Course, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising under these Terms will not exceed the total Course Fees you have paid in the six (6) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend and hold harmless Omega Collega SA and its affiliates from any claims, liabilities, losses, damages, costs or expenses (including reasonable legal fees) arising from or related to your breach of these Terms or your use of the Site or Services.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the South African courts.

12. Changes to Terms

We may modify these Terms at any time by posting an updated version on the Site with a new “Last updated” date. Your continued use after changes constitutes acceptance of the revised Terms.
